Official Rules

THIS CONTEST IS INTENDED FOR PARTICIPATION ONLY IN THE UNITED STATES AND THE DISTRICT OF COLUMBIA (INCLUDING ITS TERRITORIES, POSSESSIONS AND MILITARY BASES) AND SHALL BE CONSTRUED ACCORDING TO, AND GOVERNED EXCLUSIVELY BY, UNITED STATES LAW. DO NOT PARTICIPATE IN THE CONTEST IF YOU ARE NOT A LEGAL RESIDENT OF THE UNITED STATES OR HAVE NOT REACHED 13 YEARS OF AGE OR OLDER AT THE TIME OF ENTRY OR YOU OTHERWISE DO NOT FALL WITHIN THE ELIGIBILITY REQUIREMENTS SET FORTH IN THE OFFICIAL RULES BELOW.

1. ELIGIBILITY: The HarperCollins “A Midsummer Night’s Dream” Writing Contest (“Promotion”) is offered and open only to legal residents of the United States and the District of Columbia (including territories, possessions and military bases) (“U.S.”) who are 13 or older in their state of legal residence. Corporate employees, officers and directors of HarperCollins Publishers (“Sponsor”) and its parent, subsidiaries and affiliated companies, contractors, and agents and those individuals/entities engaged in the development of, the production or distribution of materials for, or the implementation of this Promotion and persons in the immediate family of (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) or those living in their same household (whether or not related) as any person in any of the preceding categories are not eligible to enter (collectively referred to herein as the “Promotion Entities”). Professional and/or semi-professional authors (whether or not published under a pseudonym), any individual who has made over U.S.$2,000 from sales of their written works in any calendar year in the past five years, or authors under contract with a competitive publishing house are also not eligible to enter.

2. AGREEMENT BY ENTRANT: All entries, voting and participation in this Promotion shall be governed by these Official Rules. By participating in the Promotion, each entrant fully and unconditionally agrees to and accepts these Official Rules, the current Terms of Use on the HarperCollins website, and any additional terms and conditions specific to the Promotion communicated by Sponsor. Entrants agree to be bound to the decisions of the Sponsor (including its authorized representatives) and Judges, which are final and binding in all matters. Further, entrants have the responsibility to review and understand applicable state and federal laws and their employers’ policies regarding their eligibility to participate in promotions and receive prizes. If an individual is participating in violation of their employer’s policies, that individual and its employer may be disqualified from this Promotion and/or from receiving prizes. Sponsor disclaims any and all liability or responsibility related to this matter, and by entering, Entrants agree to release and hold Sponsor harmless from same.

3. PROMOTION PERIOD/JUDGING PERIODS: Promotion starts on or about 12:00 am [ET] on March 7, 2011 and ends on 11:59 pm [ET] on April 29th, 2011 (“Promotion Period”). All time referenced herein is Eastern Time. Sponsor’s administrator’s server/computer is the official time keeping device for the Promotion.

ENTRY PERIOD: All entries must be received by Sponsor between 12:00 am ET on March 7, 2011 through 11:59 pm ET on April 19, 2011 (“Entry Period”). Entries will be subject to public viewing during the Entry Period.

PUBLIC VOTING PERIOD: Between 12:00 am ET on March 14, 2011 through 11:59 pm ET on April 26, 2011 the first 250 words, plus the end of any sentence commencing within the first 250 words, of each eligible Entry (the “Entry Excerpt”) will be subject to public vote (“Public Voting Period”) by registered visitors to www.facebook.com (the “Promotion Website”). Although the Entry in its entirety will be capable of being viewed by the voting community in their individual discretion (the “Voting Community”), the Voting Community will be asked to apply the public voting criteria below only to the Entry Excerpt. For purposes of the Promotion, a "vote" means a vote cast on the Website, by a "unique voter." A "unique voter" is an individual person (a) who has registered on the Website (b) with unique registration information (i.e., email address) that is not duplicative of another voter.
This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Information provided by Entrants and voters is delivered to Sponsor and the Promotion Entities assisting in the administration of this Promotion. The information you provide will only be used for purposes of administering this Promotion, except that the Entries may be used for other purposes as set forth in these Official Rules.

FINALIST JUDGING PERIOD: Eligible Finalist Entries as a whole will be subject to Finalist judging to be held on April 27, 2011 through April 29, 2011 (“Finalist Judging Period”).

4. HOW TO ENTER: During the Entry Period, visit www.inkpop.strutta.com, follow the directions to provide your information, and submit an creative writing project in five thousand (5,000) words or less that reimagines a scene or Act from A Midsummer’s Night Dream by William Shakespeare through the perspective of one of the following characters: Hermia, Helena, Lysander, Demetrius, Titania, or Puck (“Entry”). Entries maybe in story, play or poetry format. Limit one story, play or poem per Entry. No person may submit more than ten (10) entries. Entries accepted on-line only; entries submitted via any other channel(s) will not be eligible for the Promotion. When your information is complete, click on the area marked “Submit.” Once submitted, Entry cannot be modified, deleted or cancelled. By entering, Entrants understand and agree that submitted eligible Entries will be posted on-line and will be subject to public viewing, streaming (i.e. “digital transmission”), and downloading (i.e. “digital distribution”). By submitting an Entry, entrants agree to be contacted by Sponsor with notices and reminders pertaining to the Promotion.

Entries become the property of Sponsor and will not be returned. Entrants may not enter through a club (or similar method), with multiple e-mail and/or street addresses, nor shall entrants use any other device or artifice to enter more than the permitted number of times. Any use of on-line contest clubs (or similar methods), robotic, automatic, macro, programmed or like Entry methods will void all such entries by such methods, and disqualify any entrant using such methods. In case of dispute, Entries will be declared made by the authorized account holder of the e-mail address submitted at the time of Entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

Promotion Entities assume no responsibility for lost, late, incomplete, inaccurate, destroyed, damaged, or misdirected Entries; nor for any computer, telephone, cable network, electronic or hardware or software malfunctions, failures, connections, or availability, or garbled, corrupt, or jumbled transmissions; nor service provider, Internet, Web site, user net accessibility or availability, traffic congestion, unauthorized human intervention or any human error, or the incorrect or inaccurate capture of Entry or other information, nor for the failure to capture any such information.

5. REQUIREMENTS FOR ENTRY: All Entries must contain a fully completed Entry Form and a five thousand word (or less) story, play or poem in English only to be eligible for the Promotion; incomplete or otherwise ineligible Entries will be disqualified. Entries sent or received via any other channel (mail, facsimile, etc.) will not be considered. Proof that you uploaded an Entry does not constitute proof or evidence that it was received within the Promotion Period or eligible for the Promotion. Sponsor reserves the right to disqualify and/or remove any Entry in whole or in part for any reason within its sole and absolute discretion if it believes the Entry is not in the spirit of the Promotion, is not compliant herewith, or will have a detrimental impact on Sponsor, this Promotion, or any of Sponsor’s brand, products or services. Without limitation, Sponsor reserves the right in its absolute discretion to refuse, disqualify, or withdraw any Entry and/or Entrants at any time during the Promotion, including but not limited for ineligibility, lack of good faith, noncompliant, or obscene, offensive, sexually inappropriate, or otherwise unsuitable Entries, such as those depicting violence, nudity or explicit activity, as determined by Sponsor (in its sole and absolute discretion).

By submitting an Entry, Entrants represent, warrant and covenant that the Entry submitted and all content therein: (i) is the original creation of the Entrant, has not been copied in whole or in part from any other work, (ii) has not been published (in whole or in part), received an award or honorable mention, nor been submitted in any other contest, competition, showing, or event; (iii) does not violate or infringe any copyright, trademark or other proprietary, publicity or privacy right of any person or entity, (iv) all Entrants, and any other persons who were engaged to work on the Entry or who are referenced or featured in the Entry in any manner have given Entrant their express written consent to submit the Entry for the use contemplated and have provided permission to be included in or with the Entry (or if a minor they have obtained consent of their parent or legal guardian) (Entrant may be asked by Sponsor to provide evidence of such permission in writing); and (v) is the sole and exclusive property of the Entrant.

At the time you submit your Entry, and whether or not your Entry is selected as a Finalist and/or winner, you grant a non-exclusive, royalty-free, perpetual right and license to Sponsor (and its authorized representatives) to post and publically display the Entry , in whole or in part, in connection with the Promotion, and Sponsor’s promotional and advertising activities. You understand and agree by granting this license your Entry may be used in whole or in part, alone or in combination with other works, by Sponsor for any advertising, marketing or promotional purposes in any media and medium whatsoever now known or hereinafter developed (including without limitation print, broadcast, radio, digital, and on-line) without further compensation or review. Sponsor will not knowingly edit or modify your Entry without your consent, and Entrant’s acknowledge that Sponsor shall bear no liability for any inadvertent edits or modifications. Further, if your Entry is selected as a Finalist or the winner, for good and valuable consideration in receiving a prize, you agree to execute all documents and perform all acts deemed necessary by Sponsor to grant Sponsor a royalty-free, worldwide, non-exclusive license to use, publish and display the Entry in whole and in part, and all the intellectual and other property rights therein for the full term of the copyright, in any and all media and medium now known or hereinafter developed (including without limitation print, broadcast, radio, digital, and on-line). You will not now nor in the future receive any payment or other compensation for your Entry or for granting Sponsor any of these rights, except as provided in Section 8 below.
Entries in whole or in part and whether or not selected as a Finalist or winner may, but without obligation, appear in Sponsor’s social media sites or electronic communications, or other promotional materials in Sponsor’s sole discretion. HOWEVER, SPONSOR MAKES NO REPRESENTATIONS, WARRANTIES OR GUARANTEES WHATSOEVER (EXPRESS OR IMPLIED) OF ANY KIND, INCLUDING THAT ANY ENTRANT WILL RECEIVE FUTURE PUBLISHING CONTRACTS OR ANY OTHER PROFESSIONAL OR OTHER BENEFIT OF ANY KIND BY VIRTUE OF THEIR PARTICIPATION IN THIS PROMOTION WHETHER OR NOT SELECTED AS A FINALIST OR WINNER.

6. PUBLIC VOTE/FINALIST SELECTION: The Entry Excerpt from each eligible Entry posted on the site will be subject to public vote based on the following criteria:(i) voice of the characters (20%), (ii) imaginative recasting of scene or Act (20%), (iii) understanding of character (10%), and (iv) overall quality of the writing (50%). A unique voter may vote no more than once each day for an Entry. If Sponsor determines, in its sole discretion, that an abuse of the "unique voter" rule has occurred, Sponsor may disqualify votes cast by such voters or Entrants, including if more than 5 of such voters or Entrants registered from the same computer "IP address". You may vote for the same Entry more than once, except that Entrants may not vote for their own Entry. Any attempt at fraud or other misuse of the voting process will disqualify all votes from that person and/or computer. Sponsor will make the Entries searchable by “Entrant” and “Title” and will also present the Entries directly on the homepage of the Website by ranking based upon votes received to date and on a rotating basis to assure equivalent presentation of each Entry to potential voters.

Twenty (20) eligible Entries with the most number of votes received during the Public Voting Period, plus any eligible Entries tied for the 20th position (where the tied number of votes is at least equal to and would have placed them within the top 20 but for the tie), will be selected as finalists to enter the final round of judging (“Finalists”). Any other ties under 20 will not be considered.

7. JUDGING CRITERIA/WINNER SELECTION: All eligible Finalist Entries will be judged by a panel of qualified judges chosen by Sponsor to select five (5) Grand Prize winners with the highest score received in this judging round. (Sponsor assumes no liability or responsibility to translate from English any Entry in whole or in part.) Each Entry in its entirety will be judged on the following criteria: quality and originality of the Entry (30%); publishable quality of writing (70%). In case of a tie, the Entry (among those tied) with the highest rating in the “Publishable Quality” category will break the tie. In the event a tie still remains, the Entry (among those tied) with the highest rating in the “Publishable Quality of Writing” category will break the tie.

8. FINALIST/OVERALL PRIZES: All prize awards are subject to final verification of eligibility and compliance with these Official Rules. Five (5) Grand Prize winners will each receive Ten (10) copies of A Midsummer’s Night Dream (price $8.99) (Approximate Retail Value (“ARV”): up to a maximum of $449.50). Sponsor reserves the right, but without obligation or warranty of any kind to consider the Grand Prize winning Entries for back-of-book publication in a trade paperback of A Midsummer Night’s Dream (promotional value only). Grand Prize winner alternate prize (5): If a Grand Prize Winning Entry is not published in back-of-book publication in the trade paperback, the author of the winning entry will instead receive an iPod Touch (Approximate Retail Value (“ARV”): up to a maximum of $299)

Limit one (1) Finalist prize, per person. Subject to verification of eligibility, all prizes will be awarded assuming sufficient eligible entries are received. No transfer, assignment or substitution of prize (in whole or in part), except Sponsor may substitute a prize of equal or greater value. Unless otherwise stated, prizes are not redeemable for cash. All federal, state, and local taxes, if any, are the sole responsibility of the prize winners. In no event will Promotion Entities be responsible to award more than the stated number of prizes herein. Any prize referenced or depicted in advertising materials is for illustrative purposes only and may not be the actual prize awarded.

Potential grand prize winner will be notified by telephone, email, and/or mail (in Sponsor’s discretion) on or about two (2) – six (6) weeks following the end of the Promotion Period, and will be required to complete, have notarized and timely return an Affidavit of Eligibility, Liability and, where legal, Publicity Release (the “Affidavit”) within ten (10) business days of notification. Potential Finalist prize winners (will be notified by telephone or email (in Sponsor’s discretion) and, subject to verification, each will receive a congratulations letter and their prize on or within four (4) – six (6) weeks of verification. If the potential grand prize winner is a minor, the minor’s parent or legal guardian will be required to execute and return the Affidavit.

9. GENERAL CONDITIONS: In the event of noncompliance, if an Entrant becomes noncompliant or ineligible during the Promotion Period, or if a potential Finalist or winner cannot be reached using the information provided on their Entry, or if a prize or prize notification is returned as unclaimed or undeliverable, that prize will be forfeited-- an alternate Finalist will not be selected. However, if a potential winner is disqualified at this stage, an alternate potential winner will be selected based on the next highest score from among all Finalists, subject to verification. Unclaimed prizes will not be awarded. BY PARTICIPATING, ENTRANTS AGREE TO RELEASE, DISCHARGE AND HOLD HARMLESS THE SPONSOR, AND ITS PARENT, AFFILIATES AND SUBSIDIARY COMPANIES, ADVERTISING AND PROMOTION AGENCIES, AND FACEBOOK, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, INDEPENDENT CONTRACTORS, REPRESENTATIVES AND AGENTS FROM AND AGAINST ANY AND ALL ALLEGED AND/OR ACTUAL CLAIMS, CAUSES OF ACTION, DEMANDS, LOSSES, SETTLEMENTS (WHETHER OR NOT LITAGATION IS COMMENCED), LIABILITIES AND DAMAGES OF ANY KIND WHATSOEVER EXISTING NOW OR ARISING IN THE FUTURE (INCLUDING, WITHOUT LIMITATION, BODILY INJURY, PERSONAL INJURY, DEATH, DISABILITY AND PROPERTY DAMAGE, VIOLATION OF PROPRIETARY, PUBLICITY, PRIVACY OR ANY OTHER RIGHT), COSTS AND EXPENSES (INCLUDING, WITHOUT LIMITATION, REASONABLE ATTORNEYS’ FEES, COURT COSTS, SETTLEMENT AND DISBURSEMENTS) DIRECTLY OR INDIRECTLY ARISING OUT OF USE OF THE ENTRY IN WHOLE OR IN PART, THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF A PRIZE, PARTICIPATION IN ANY CONTEST AND/OR PRIZE RELATED ACTIVITY, ACCESS TO THE WEB SITE, AND/OR OTHER PARTICIPATION IN THIS PROMOTION. 10. LIMITATIONS OF LIABILITY: Promotion Entities are not responsible for any incorrect or inaccurate information, whether caused by Web site users, human error, tampering, hacking or by any of the equipment or programming associated with or utilized in the Promotion and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications failure, theft, loss or destruction of Entries. Promotion Entities are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from downloading materials from or use of the Web site. If, for any reason, the Promotion is not capable of running as planned by reason of, but not limited to, tampering, unauthorized intervention, fraud, technical or other failures or errors, or any other causes which Sponsor deems, in its sole opinion, could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion and select the Finalists and/or winners from Entries received prior to the action or as otherwise may be deemed fair and equitable by Sponsor. Promotion Entities shall not be liable to Finalists and/or winners or any other person for failure to execute the Promotion, or supply a Prize or any part thereof, by reason of any act of God, any action(s), regulation(s) order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any similar or dissimilar event beyond their reasonable control.

All requests for a list of winners must be received by 12/1/2011. Limit of one request per person or household.
